POCRRVE

The Covenants, Conditions, and Restrictions of Rancho Ruidoso Valley Estates require that all exterior building projects and structures be submitted in writing to the Architectural Review Committee and/or the Board of Directors for approval.
The process for submitting and obtaining approval is designed to be straight-forward:
>> Obtain a submission package
>> Complete the package and submit it in writing for approval
>> Package reviewed for compliance and/or variances
>> Requestor notified of approval or denial

Process:
The following outlines how submissions to the ARC are to be made and what process is followed:

Notify POCRRVE of the desire to submit a request to ARC. Please provide your name, address, and telephone number to: ​​

POCRRVE will notify ARC Chair (or their appointed delegate) of the request

ARC will provide the requesting member, or potential member, with a copy of the ARC Guidelines package.

ARC Guidelines package will be mailed to the requestor within five (5) working days
-
ARC Guidelines package will consist of the following:

Outline of process and associated timelines

References to most common items in CCR's and additional detail

Standard form for making submissions to ARC

Copy of current POCRRVE CCR's

Requesting member, or potential member, completes submission (per standard form) and submits to ARC
-
ARC provides written notification of receipt of completed submission to
requestor-
ARC and/or Board has 30-days from receipt of completed submission to provide the requestor a response indicating either approval or denial
-
Failure on the part of the ARC and/or Board to provide the above
response to the requestor within the 30-day timeframe will constitute approval of the submission

ARC reviews submission

ARC member will contact the requestor for additional information and/or further specifics if required
-
ARC member(s) will arrange for an onsite visit as required

ARC will review requests and findings at either regularly scheduled or special ARC meeting

Determination
-
ARC will make determination regarding approval or denial in circumstances where no variance to existing CCR's is present
-
ARC will provide a recommendation to the Board in circumstances
where a variance to existing CCR's is present, and the Board will make the final determination regarding approval or denial

ARC or Board provides written notification to the requesting member, or potential member, of the determination
-
Copies of all documents regarding the submission will be kept in ARC
files

Every ARC determination and/or recommendation: variance or not, approved or denied; will be presented to the Board for review and file

The following is intended to assist you in making submissions to the ARC. It highlights some of the most common areas of concern for POCRRVE members, as well as points you to those corresponding sections in the Declaration of Covenants, Conditions, and Restrictions ofRancho Ruidoso Valley Estates (CCR's) which will provide you with details and guidance. It also includes points of emphasis around some of the most important tenets of our CCR's. This is by no means a complete list of CCR items, so please review the CCR's (copy enclosed herein) in their entirety.

General Items:

Eligibility:
-
ARC and/or Board of Directors approvals will not be granted to POCRRVE members who are not in ‘good standing’ with published RRVE Property Assessment Dues or who are found to be currently in violation of other POCRRVE CCR's. (Sections #6 and #7 in the OCR's address this item)

Type of Homes:
-
Site-built homes must be constructed of new materials
-
Manufactured or Modular homes must be newly manufactured homes
-
Only one (1) home is permitted on a lot
-
The minimum size of the home shall be not less than 1,000 square feet
-
No singlewide mobile, modular, or manufactured home is permitted
-

Project Planning:

Follow The Process:
-
For your own protection, do not finalize house plans, additions, outbuildings, or any other structure, or alter common areas in any manner without first submitting the required information, as outlined in the CCR's, to the ARC for review and approval.

Timelines:
-
Plan on all ‘exterior’ work on your project being completed within one (l) year from project commencement
-
The ARC requests that all projects begin within six (6) months of project approval, to avoid the need for re-submission (Section 1(d) in the CCR's addresses this item)

Plans and Documents:​
-
​​Provide exterior plans for all buildings and structures along with plats showing the location and placement of same on the lot
-
Plans to include, but are not limited to, the following:
-
approximate home or improvement location on the lot
-
dimensions as to length, height, width, etc.
-
location of driveways, sidewalks, garages, or other structures
-
location of utilities on the lot
-
elevation photograph from the builder or manufacturer (if applicable) (Sections #1{d}, #1{a}, #1{p}, and #1{s} in these CCR's address these items)

Approvals granted by the ARC and/or Board of Directors shall indicate the property owner is in compliance with the POCRRVE CCR's only; and any planned building or other improvement must also comply with existing County, State, or Federal government requirements. If a project does require County, State, or Federal approval, appropriate permits should be promptly applied for and are the sole responsibility of the property owner.

Project Construction:
-
No construction, application of fill dirt or grading, clearing of land, etc. may commence prior to receiving ARC and/or Board of Directors approval (Sections #1{d} and #1{j} in the CGR's address these items)

A drainage culvert of no less than 18 inches at the driveway entrance is required per Lincoln County Ordinance #82-2 and requires a County permit (Section #1{f} in the CCR's addresses this item)
-
No alterations of the natural flow of water within common areas, such as cul-de-sacs, utility right of way, or parks are permitted prior to ARC review and approval
-
Building setbacks will be at least 15 feet from any side or rear lot line, and at least 30 feet from the front property line
-
Setbacks are measured from that portion of the structure closest to the property line including decks, overhangs, patios, or attached walls (Section #1{e} in the CCR's addresses this item)

Materials (i.e. roofing, siding, skirting, foundation, etc.) (Section #1{d} in the CCR's addresses these items)
-
Appliances and other equipment (i.e. air conditioners, coolers, propane tanks, etc) (Section #1{m} in the CCR's addresses these items)

Fencing (Sections #1{n}, #1{o}, and #1{s} in the CCR's address this item)

Contractors It is the Property Owner's responsibility to:
-
Inform contractors of the location of utility connections and lines
-
Inform contractors that clean up and removal of debris is their responsibility
-
Inform contractors that damage to streets, ditches, or lots is their responsibility to ensure all easement rights are understood

Exceptions:
-
Under certain circumstances, exceptions to the requirements contained in the CCR's may be permitted. Any variance from the CCR's must be requested in writing (using the process described in the ARC Guidelines Package) and approved in writing by either the ARC or the Board of Directors.

An exception, or variance granted in one instance does not necessarily imply that the ARC or the Board of Directors is obligated to approve a similar exception again. Each instance is reviewed on its own merits and circumstances.
